    Simsai Construction Group Pty Ltd (‘Simsai’) ABN 81 140 985 548 is made up of the following brands which offer high quality built homes, in the single story, two story and multi development market:

    • First Home Buyers Direct;
    • Pottier Homes;
    • Multi Develop 360; and,
    • Filipino Home Buyers.

    For clarity, any reference to Simsai throughout this document should be taken to include any or all of the above mentioned brands.

    This page outlines the terms and conditions associated with:

    • Any website published and managed by Simsai;
    • Any social media profile published and managed by Simsai;
    • Any content published and managed by Simsai; and,
    • Any promotion published and managed by Simsai.

    PROMOTION: FHBD BIG STIMULUS PACKAGE

    Promoter: Simsai Construction Group Pty Ltd T/as First Home Buyers Direct (‘FHBD’) ABN: 81 140 985 548.

    Promotion: FHBD Big Stimulus Package.

    Promotion Period: The Promotion, available to eligible applicants only, commences on the 1st of June 2020 and ends on the 31st of July 2020 unless otherwise amended by the Promoter in accordance with these terms and conditions.

    The promotion is available to residents of Western Australia (‘WA’) who are over the age of 18 years old.

    Eligible applicants enter the promotion on these terms and conditions.

    To participate in the Promotion an eligible applicant must enter into an agreement to purchase an eligible property with the Promoter.

    To participate in the Promotion an eligible applicant must complete the purchase and settlement of an eligible property with the Promoter.

    Applicant eligibility is subject to applicant satisfying the eligibility criteria and all decisions around eligibility are at the discretion of the Promoter.

    FHBD Big Stimulus Package Promotion: Promotion Details & Eligibility

    Under the promotion, eligible applicants may be entitled to receive the following:

    1. Subject to eligibility, up to $35k additional value included in the home build for a cost of just $1,990 ('UChoose Stimulus Package')
    2. Subject to clauses eligibility, eligible applicants may be entitled to receive the First Home Owners Grant (‘FHOG’) to the value of $10,000 towards the purchase of an eligible property.
    3. Subject to the eligibility requirements set by the Federal and State government, applicants may be eligible to receive a grant of up to $45,000 towards their new home (‘New Home Grant’ - up to $25,000 Federal Grant and up to $20,000 State Grant).

    The maximum value that an eligible applicant who is participating in the Promotion can access through the Promotion is $90,000.

    To receive the UChoose Stimulus Package benefit listed at 1 above, the eligible applicant must have:

    • Signed a building contract for an eligible property with the Promoter;
    • Secured finance and valuation approval for the eligible property; and,
    • Arranged for payment of $1,990 to be made to the Promoter.

    To access the FHOG benefit listed at 2 above, the eligible applicant must satisfy the eligibility requirements specified by the WA Government, including:

    • The eligible applicant must be over the age of 18 years;
    • At least one of the applicant’s, either the eligible applicant or another individual on the FHOG application must be an Australian Citizen or permanent resident;
    • The eligible applicant and/or their spouses or de facto partners cannot have previously received the grant or first home owner rate of duty from any jurisdiction in Australia
    • The eligible applicant and/or their spouses or de facto partners cannot have owned residential property anywhere in Australia before 1 July 2000;
    • The eligible applicant and/or their spouses or de facto partners cannot have owned residential property anywhere in Australia on or after 1 July 2000 and occupied that property as a place of residence before 1 July 2004;
    • The eligible applicant and/or their spouses or de facto partners cannot have owned residential property anywhere in Australia on or after 1 July 2000 and occupied that property as a place of residence for a continuous period of at least six months that began on or after 1 July 2004;
    • The eligible applicant must occupy the eligible property as a principal place of residence for a continuous period of at least six months commencing within 12 months of settlement if purchasing a home, or within 12 months from the date of completion if building a home;
    • The eligible applicant must hold a relevant interest (ownership) in the land on which the eligible property is situated and must own the eligible property in their own capacity. A relevant interest may include a right of occupancy;
    • If the eligible applicant owns the eligible property as a trustee, it must be held on trust for a person with a legal disability; and,
    • Any other requirements that the WA Government Department of Finance specifies need to be satisfied, more information on eligibility for the FHOG can be found at: https://www.wa.gov.au/organisation/department-of-finance/fhog; and,
    • All FHOG approvals are at the discretion of the WA Government Department of Finance.

    To receive the New Home Grant benefit listed at 3 above, the applicant must make the relevant applicants with the Federal and State government bodies. All  New Home Grant approvals are subject to the applicant satisfying the State and Federal government eligibility requirements and all grant approvals are at the discretion of the Federal and State government.

    FHBD Big Stimulus Package Promotion: Payment of Benefits

    Failure to satisfy the Promoter of the eligibility requirements will result in the associated benefit not being received.

    Each applicable benefit will be provided to the eligible applicant in the following specified manner:

    • For the UChoose Stimulus Package, an additional $35k value is included in the eligible applicants home via either high ceilings or double glazing throughout the home (eligible applicant to choose one) and via the Bonus Stimulus Specification with sustainability, smart tech, bathroom and 900mm kicthen package inclusion upgrades. A full breakdown of the Bonus Stimulus Specification will be provided by the Promoter on request.
    • For the FHOG benefit, this is not paid directly to the eligible applicant and will be paid by the WA Government department of finance towards the purchase cost of the home.
    • For the New Home Grant benefit, in the method specified by the State or Federal government.

    FHBD Big Stimulus Package Promotion: General Conditions

    • Any applicable benefits will be provided in accordance with these terms and conditions.
    • Applicant eligibility to receive the Uchoose Stimulus Package is at the sole discretion of the Promoter.
    • Any applicable benefits are non-transferable and may not be converted into cash or any other form of tender.
    • The Promotion is only available on its own and not in conjunction with any other promotions that are currently being offered by the Promoter with the exception of the referral rewards promotion.
    • All eligible applicants agree to be bound by these terms and conditions.
    • The Promoter reserves the right to terminate the Promotion at any time without further notice to eligible applicants.
    • Should there be any inconsistency between these terms and conditions and any other published information in relation to the Promotion, these terms and conditions will prevail.
    • Any personal information collected by the Promoter throughout the course of the Promotion will become the property of the Promoter and will be handled in accordance with the relevant privacy laws and regulations.

    • An eligible applicant may only enter the Promotion once.
    • The Promoter and their related bodies, entities and associated persons disclaim all liability for any losses or damage which is suffered or sustained by an eligible applicant in relation to the Promotion.
    • These terms and conditions are governed by the laws of WA.
    • In the event that any term or clause in these terms and conditions is deemed to be invalid, unenforceable, or illegal, the same will not have an impact on other terms or clauses in the terms and conditions.

    PROMOTION: SIMSAI REFERRAL REWARD PROGRAM

    Promoter: Simsai Construction Group Pty Ltd ABN: 81 140 985 548.

    Promotion: Simsai Referral Reward Program.

    Promotion Period: The Promotion, available to eligible applicants only, runs for an indefinite period unless otherwise amended by the Promoter in accordance with these terms and conditions.

    The promotion is available to residents of Western Australia (‘WA’) who are over the age of 18 years old.

    Eligible applicants enter the promotion on these terms and conditions.

    Simsai Referral Reward Program: Eligibility

    You will be eligible to participate in the Simsai referral reward program if you are over 18 years of age and currently residing in Australia.

    When you introduce a client to Simsai:

    • For an eligible purchase of a house and land package;
    • In accordance with the referral requirements outlined;
    • Where the client has not been in contact with Simsai within a 30 day period prior to the introduction;
    • Where the client has not registered with another builder within the 14 days prior to you making the introduction;
    • Where the client enters into signed agreement to purchase a house and land package within 14 days of you referring their details to Simsai; and,
    • Subject to the terms outlined below;

    You will be eligible to receive the referral reward of $3,000.

    • If more than one individual claims the reward in relation to the referred client, the first formal introduction determined by email date and time within the 14 day period will be the referral paid irrespective of the circumstances and all decisions in relation to this will be at the discretion of Simsai.
    • A referral is valid for 14 days, determined by email date and time. If the referral has not entered into a signed agreement to purchase a house and land within this 14 day period then the referral will expire and you will not be eligible to receive a referral reward.
    • Where a client is referred and there are co-applicants who are also entering into the sale agreement, the co-applicants will not be deemed to be a referred client for the purposes of receiving a referral reward and only one referral reward will be available per contract of sale.
    • If your referral satisfies the eligibility and referral requirements outlined in this document, you will receive a referral reward of $3,000 paid via EFT transfer into your nominated bank account.

    Simsai Referral Reward Program: Referral Requirements

    To refer a client to Simsai, you are required to provide a formal email notification to a Simsai owned email account.

    The following information must be included in the formal email notification:

    • Full name of client being referred;
    • At least one valid contact number for the referred client; and,
    • At least one valid email address for the referred client.

    The referred clients’ details will be checked by Simsai’s administration team to see if the referred client has been in contact with Simsai within the last 30 days or registered with another builder within the last 14 days and will advise you if a referral reward is available or not via return email.

    If a referral reward is available and if the referred client enters into an agreement to purchase a house and land package with Simsai within 14 days from the date that you referred their details, you will be required to complete the ‘Referral Reward Confirmation Form’ prior to receiving your referral reward payment.

    This form will be emailed to you to complete, sign and return after the sale contracts have been completed and signed by the referred client.

    A recipient created tax invoice will be issued to you after the contract of sale becomes unconditional and will be paid to you within 30 working days of the slab payment being received by Simsai in relation to the referred clients purchase.

    Simsai Referral Reward Program: General Conditions

    • The Terms and Conditions outlined in this document are subject to review and amendment or discontinuance at any time without notice.
    • Only one (1) referral reward will be payable per completed sale.
    • The reward will only be paid 30 working days from the slab payment being received to Simsai in relation to the referred clients purchase.
    • Simsai reserves the right not to issue a reward should the referred client be an active prospect (contact within a 30 day period prior to the introduction) on the Simsai database.
    • To the fullest extent permitted by law, Simsai reserves the right to: Cancel, modify, suspend or terminate the reward without notice; Exclude any application for reward which has not been completed correctly or is illegible; or, Change the value of the reward.
    • The reward is only available for eligible house and land packages (determined by Simsai) which are directly purchased from Simsai.
    • The individual referring the client warrants that they have disclosed all details of the reward to the client.
    • The individual referring the client warrants they have obtained all necessary permissions and consents to refer the client details.
    • An eligible reward will be provided to the eligible individual within twenty (20) working days of the settlement of the contract of sale, at the discretion of Simsai and subject to compliance with the terms and conditions outlined in this document.
    • The Terms are governed by all laws and regulations in force in the State of Western Australia.
    • In the event that any term or clause in these terms and conditions is deemed to be invalid, unenforceable, or illegal, the same will not have an impact on other terms or clauses in the terms and conditions.
    • By making a referral to Simsai Construction Group you agree that you understand, acknowledge and accept the Terms and Conditions relating to the reward.

    PROMOTION: QUOTE QUEST

    Promotion: Quote Quest.

    Promotion Period: The Promotion, available to eligible applicants only, runs for an indefinite period unless otherwise amended by the Promoter in accordance with these terms and conditions.

    Eligibility: You are eligible to receive $100 cash back if you meet the following conditions:

    • You must provide a written quotation from a competitor that includes a breakdown of all inclusions;
    • You must provide an electronic sketch design from a competitor that shows room dimensions and the total living area of the sketch design;
    • You must provide the full specification from a competitor; and,
    • The Quote, Sketch and specification must be date stamped within 3 months of submission to the quote quest system.

    The terms and conditions of this promotion are subject to review without notice and all eligibility decisions are at the sole discretion of the Promoter.
